The U.S. Environmental Protection Agency (EPA) is initiating consultation with federally recognized Indian Tribes to obtain input on the agency’s proposed action “Reconsideration of Standards of Performance for New, Reconstructed, and Modified Sources and Emissions Guidelines for Existing Sources for the Oil and Gas Sector.” This is a narrow reconsideration action where the EPA is proposing technical changes to limited aspects of the final Standards of Performance for New, Reconstructed, and Modified Sources and Emissions Guidelines for Existing Sources: Oil and Natural Gas Sector Climate Review, published on March 8, 2024 (89 FR 16820).
The EPA’s anticipated timeline for the consultation period is expected to extend through February 10, 2025. This consultation process will be conducted consistent with the EPA Policy on Consultation with Indian Tribes2 and the Guidance for Discussing Tribal Treaty or Similar Rights.3 The EPA invites you and/or your designated consultation representative(s) to participate in this process to discuss information related to the Reconsideration of Standards of Performance for New, Reconstructed, and Modified Sources and Emissions Guidelines for Existing Sources for the Oil and Gas Sector.
